Just to let you know that the latest ESA decision from the PSLRB is another clear victory for the Union.
Background: The CBSA proposed 100% of the Border Services Officers as essential during a strike arguing that ALL duties performed BSO's are essential to the safety and security of the public. PSAC challenged this arguing that the assessment and collection of duties, taxes, fees and fines and related administrative duties are not essential to the safety or security of the public. The PSLRB agreed with the Union and ordered that duties such as assessing and collecting duties, etc. are not essential services.
Result of this: I haven't yet talked to my TB counterpart - but I am assuming that CBSA will now have to go back and try and determine what percentage of a BSO's workload is related to non-essential tasks and then reduce its proposal by that percentage. It will likely not reduce the numbers significantly because it is clear that a majority of the BSO duties are essential - however, this decision adds to the growing body of jurisprudence that will help protect our members right to strike.
